Agreement
These terms are an agreement between you and ObviousCall LLC, an Arizona limited liability company ("ObviousCall," "we," "us") for using obviouscall.com and the ObviousCall app (the "Service"). By creating an account or using the Service you agree to them. If you use the Service for an organization, you confirm you can bind that organization to these terms.
Accounts
You must give accurate information and keep your sign-in secure. You are responsible for activity under your account. You must be at least 13 to have an account; players under 18 take part through a parent, guardian, coach or organizer.
Organizers and their events
Tournament directors, assigners and camp directors ("Organizers") control their events, including who is invited, how games are assigned, what officials and staff are paid, and what fees teams pay.
Organizers are responsible for having the right to enter the information they add, for the accuracy of rates and fees, and for their own obligations to the teams, officials and staff they work with. ObviousCall is not the employer of any official or staff member and is not a party to the arrangements between Organizers, teams, officials and staff.
Events and physical activity
ObviousCall is software. We do not organize, run, supervise or insure any tournament, camp or game, and we are not responsible for venues, travel, health or safety at events, or injuries that happen at them. Those are the responsibility of the Organizer and the people taking part.
Fees and payments
The Service is free to start. If you choose a paid feature, its price is shown before you are charged.
Payments and payouts are processed by Stripe and are subject to Stripe's terms. Officials and staff must complete payout and tax setup, including a W-9 where required, to be paid through the Service.
Organizers who collect payments or pay people through the Service must accept the Stripe Connected Account Agreement, and are responsible for refunds, disputes and chargebacks on their events. Stripe may delay or hold payouts under its own terms.
Refunds of team or registration fees are set by the Organizer of that event. Fees paid to ObviousCall are non-refundable except where the law requires otherwise.
Officials and staff paid through the Service may receive tax forms, such as a 1099, as the law requires.
Text messages
If you agree to receive texts, we send event messages such as assignments and schedule changes. Message and data rates may apply. Reply STOP to opt out or HELP for help.
Scout and AI drafts
Scout produces drafts. You are responsible for reviewing anything before you approve, send, publish or release it. Nothing Scout drafts takes effect until a person approves it.
Your content
You keep ownership of the information you add. You give ObviousCall permission to host, process and display it as needed to run the Service for you and the people in your events. We handle personal information as described in the Privacy Policy.
Acceptable use
Do not misuse the Service: no unlawful activity, no harassment, no false information about other people, no access to data you are not entitled to, no attempts to break or overload the Service, no scraping or automated collection without our written permission, no impersonation, and no reselling it without our written permission.
Our property
ObviousCall owns the Service, including its software, design and the ObviousCall name and logo. You may not use our name or logo without written permission. If you send us feedback or ideas, we may use them without obligation to you.
Third-party services
The Service connects to services run by others, such as Stripe for payments and Google for sign-in. Their terms govern your use of them, and we are not responsible for them.
Copyright complaints
If you believe content on the Service infringes your copyright, email hello@obviouscall.com with the work, where it appears, your contact details, and a statement that you believe in good faith the use is not authorized. We remove infringing content and close the accounts of repeat infringers.
Our service
We keep improving the Service and may change or remove features. We may suspend or close an account that breaks these terms. You may stop using the Service at any time, and may ask us to delete your account as described in the Privacy Policy.
Disclaimers
The Service is provided "as is" and "as available." We do not promise it will be uninterrupted or error free. Schedules, assignments and notifications depend on the information Organizers and users enter, and you should confirm anything critical to your event.
Limitation of liability
To the fullest extent the law allows, ObviousCall is not liable for indirect, incidental, special or consequential damages, or for lost profits or data. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or $100.
Indemnity
If you are an Organizer, you will defend and indemnify ObviousCall against claims arising from your events, your content, or your arrangements with teams, officials and staff.
Governing law
These terms are governed by the laws of the State of Arizona. Disputes will be resolved in the state or federal courts located in Maricopa County, Arizona.
General
These terms and the Privacy Policy are the whole agreement between you and ObviousCall about the Service. If any part is found unenforceable, the rest stays in effect. Not enforcing a term is not a waiver of it. You may not transfer these terms without our consent; we may transfer them as part of a merger or sale of the business. Sections that by their nature should survive the end of this agreement do.
Changes and contact
If we change these terms materially, we will update the date above and tell account holders before the change takes effect. Questions go to hello@obviouscall.com.
